On November 5, 2013, Region 2 issued an Administrative Order on Consent to the Respondent, pursuant to Section 3013 of RCRA, 42 U.S.C. § 6934. The purpose of the Order is to require the Respondent to conduct monitoring, testing and analysis to determine the scope of the releases of hazardous wastes or constituents of hazardous wastes at its facility, located in Mata de Plátano Ward, Luquillo, Puerto Rico. The Respondent is required to submit written proposals to ascertain the nature and extent of the hazards posed by the hazardous wastes or hazardous constituents that are present at or that may have been released from the facility. The Order further requires the Respondent to implement such proposals once approved, or modified and approved, by EPA.
