The Respondent owns and operates a bar and restaurant located at 906 Schellengers Landing Road in Cape May, NJ on a 130-foot long permanently moored floating craft, the Schooner American (Facility). On August 14, 2014, EPA conducted a Compliance Evaluation Inspection of the Facility and identified wastewater, containing alcohol, juice and detergent, from the bar sink and wash sink on the Schooner American was being discharged to Schellengers Creek at Cape May Harbor via two (2) collection pits containing float and pump systems and two (2) discharge pipes. The Respondent does not have coverage under a NJDEP NJPDES permit for the wastewater discharges, as required by the CWA.
