Case summary
Respondent owns and operates the Mack Studios construction site located in Auburn, NY. EPA conducted a Compliance Evaluation Inspection (CEI) at the site on May 16, 2014. At the time of the CEI, approximately 4 acres of soil were disturbed. A turbid stormwater discharge was identified flowing from the site and was conveyed to wetlands hydraulically connected to the Owasco Outlet. Respondent failed to comply with the conditions of its NYSDEC SPDES Construction General Permit by, among other things, failing to implement and maintain erosion and sediment control measures specified in its SWPPP, failing to implement corrective actions subsequent to inspection notifications, and failing to maintain records on-site. The Administrative Order requires the Respondent to comply with its SPDES Construction General Permit.
