EPA v. Town of Colonie (MS4)
Unilateral Administrative Order Without Adjudication
Case summary
On September 3 through 5, 2013, EPA conducted an audit of the Town's MS4 and identified the Town was not complying with certain terms and conditions of the NYSDEC MS4 General Permit, including failure to complete self-assessments of municipal facilities and failure to make reasonable progress in completing outfall reconnaissance inventory at every outfall every five (5) years. An Administrative Order is being issued to order the Town to comply with MS4 General Permit conditions. Pollutant reductions were calculated for the stormwater runoff from the Public Operations Building, including stockpiles exposed to stormwater, for discharges to the MS4.
