Case summary

On May 24, 2022, the Consent Judgment was entered settling EPA's enforcement action against the Defendant and related companies. The settlement requires Defendants to pay a civil penalty of $250,000 in four installments and to ensure and certify compliance with the Part 280 requirements at 29 service stations at which Defendants presently own and/or operate USTs (which includes 18 stations not listed in the complaint). Among other requirements, the Defendants have to ensure they have: (a) installed and maintained devices to prevent spills and the overfilling of USTs, (b) provided a method of rapid release detection to quickly detect releases before they spread, (c) maintained the integrity of the UST systems, and (d) complied with financial responsibility requirements for corrective action and compensating third parties for bodily injury and property damage in case of any leaks or spills.
