Case summary

Requesting DOJ file a proof of claim in the bankruptcy proceedings of the Defendant. Prior to the bankruptcy filing, and since May 2013, the EPA has been negotiating an Administrative Order on Consent with the Defendant, which documented violations of Sections 301, 308, and 402 of the Clean Water Act (CWA), at ten of its bus facilities in New York and New Jersey. The Order required the Defendant to come into compliance with the CWA and applicable State Pollution Discharge Elimination System permits. The January 31, 2017 Settlement Agreement resolves setoff negotiations between Debtors and the United States, which have been ongoing since 2014.
