Case summary
The Environmental Protection Agency (EPA) received a tip/complaint alleging the Respondent was renovating the interior of a pre-1978 apartment building, at 36 Gramercy Park East, New York, NY 10003, without following the lead-safe work practices mandated by the Renovation, Repair & Painting Rule. An on-site inspection was conducted on January 4th, 2011. Alleged violations were identified by EPA and outlined in the Opportunity to Show Cause for Violations letter (SCL) which was first issued to the Respondent on on March 28, 2012. The President of the company claimed he never received the first SCL, therefore a second SCL was issued on May 30, 2012. After the second SCL was received, informal settlement conferences were held between EPA and the Respondent. A reduced penalty was sought based on a demonstrated inability to pay the initial proposed penalty.
