Case summary
The Project is an on-going construction activity by the Developer on a 40 acre parcel in Estate Donoe, St. Thomas and is expected to utilize 33.7 acres upon completion. The Facility is permitted to discharge pollutants associated with storm water related to the construction activities on the site. Compliance inspections performed by EPA at the facility in July 2012 and March 2013 revealed the facility had been operating in gross non-compliance with its TPDES Permit and related regulations implementing the CWA. EPA took enforcement action against the Operator and Developer, and issued an ACO in August 2013 to bring the Facility into full compliance with its Permit and the CWA.
