Case summary
Respondent owns and operates the Beckers Crossing Phase IV and V construction site located in the Rotterdam, NY. EPA conducted a Compliance Evaluation Inspection (CEI) at the site on April 3, 2013. At the time of the CEI, approximately six (6) acres of soil were disturbed. The Respondent failed to comply with the conditions of its NYSDEC SPDES Construction General Permit by failing to implement and maintain erosion and sediment control measures specified in its SWPPP, failing to obtain written authorization to disturb greater than five (5) acres of soil at any one time from the NYSDEC or MS4, and failing to implement corrective actions subsequent to inspection notifications. The Administrative Order requires the Respondent to comply with its SPDES Construction General Permit.
