Case summary

EPA conducted an inspection at Respondents’ facility on April 12, 2011 in response to a citizen complaint about poor management of environmental wastes resulting in discharges into parking lot storm drains. The inspection revealed that Respondents did not inventory any of the storm water drywells or septic system drywell at the facility with the EPA; and industrial contaminants were being discharged to three of the storm water drywells. EPA issued an order to cease injection of the industrial contaminants, clean out the storm water drywells and implement Best Management Practices (BMPs). Injunctive relief was estimated based on volume of soil remediated in three storm water dry wells, cost to remediate three dry wells, and cost to implement BMPs.
