Case summary

As a result of the inspection, it was determined that the Respondent processed polycyclic aromatic compounds (PACs) at the Linden site. An average of 400 pounds of PACs were processed at the facility during each of calendar years 2008, 2009 and 2010 as part of the hot mix asphalt paving material produced at the facility. Each failure to submit a Form R report, in a timely manner, constitutes a violation of Section 313 of EPCRA, 42 U.S.C. §11023, and of 40 C.F.R. §372.30.
