Case summary
Respondent owns and operates a scrap metal recycling facility located on 5057 State Highway 12 in Norwich, NY. The Respondent failed to obtain coverage under the NYSDEC Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity and discharged without a Permit from January 26, 2010 to March 12, 2011. After obtaining coverage under Sector N of the MSGP, the Respondent failed to implement the SWPPP, failed to document inspections and monitoring required by the Permit, and failed to maintain a complete SWPPP onsite and available for review, in violation of the Permit. Stormwater discharges from the site to the Chenango River via a drainage ditch and culvert pipe, which passes beneath State Highway 12.
