Respondents own/operate a large CAFO in Ferndale, NY that failed to comply with manure application recommendations in the CNMP, failed to properly operate and maintain all facilities and systems of treatment and control, failed to adequately retain records and failed to exclude clean water from concentrated waste areas in violation of the NYSDEC CAFO General Permit. Stormwater discharges from the Facility to the Middle Mongaup River in the Delaware River drainage basin. The final administrative penalty order includes a penalty for violations identified as a result of the April 18, 2012 inspection.
