Respondent owns and operates an automobile recycling facility located on Avenue P in Newark, NJ and failed to implement the SPPP, failed to berm the vehicle processing area, failed to store batteries and engine blocks under cover protected from stormwater, in violation of NJPDES Scrap Metal Processing/Auto Recycling (SM2) General Stormwater Permit. Stormwater discharges from the site to Newark Bay via a catch basin located on Avenue P. The final administrative penalty order includes a penalty for violations identified as a result of the 11/21/11 inspection. Injunctive relief has already been included in the CCDS for Administrative Order CWA-02-2012-3017.
