Case summary
EPA issued the Respondent a Request for Information (CWA-IR-12-010) on February 24, 2012, pursuant to Section 308 of the CWA, requiring submission of information within thirty (30) calendar days of receipt regarding the MS4 and Sanitary Sewer System, including but not limited to updates on a number of projects, infrastructure improvements and operation and maintenance procedures to identify and reduce infiltration from various sources into the East Orange Sanitary Sewer System. The Respondent was granted a 60 day extension beyond the original 30 day deadline and has been issued a formal overdue notice. To date, the Respondent has failed to submit the information required by the RFI, in violation of Section 308 of the CWA. This AO requires the City to Show Cause why EPA should not file a complaint for the commencement of civil and/or criminal penalties; therefore, pollutant reductions are not applicable to compliance with this Order.
