Case summary
Respondent is a large dairy CAFO in Ferndale, New York that is not complying with the terms and conditions of the NYSDEC CAFO General Permit. The facility failed to comply with manure application recommendations in CNMP, failed to properly operate and maintain all facilities and systems of treatment and control, failed to adequately retain records and failed to exclude clean water from concentrated waste areas in violation of the Permit. This AO requires the permittee to address violations identified. The over application of manure resulted in a relatively large calculated pollutant loading, however, applying manure according to the CNMP can be completed at a minimal cost to the permittee because the permittee already currently exports most of its manure to fields at other farms.
