EPA v. Casler Farm (SB)
Unilateral Administrative Order Without Adjudication
Case summary
Respondent is a medium dairy CAFO in West Winfield, New York that is not complying with the terms and conditions of the NYSDEC CAFO General Permit (GP-04-02). The facility failed to implement CNMP practices in response to high risk practices. An Administrative Order was issued on June 24, 2011 (CWA-02-2011-3039) to order the facility to comply with Permit conditions. This Order establishes a revised compliance schedule due to funding limitations and timing with the grant application process for the design and construction of the silage leachate control system. Injunctive relief and pollutant reduction calculations associated with this case have been incorporated in the previous AO (CWA-02-2011-3039).
