Case summary
Facility is a medium CAFO in Bath, NY. Inspection was conducted on May 12, 2010. The facility was determined to be in noncompliance with the terms and conditions of the NYSDEC CAFO General Permit. An Administrative Order (CWA-02-2010-3045) was issued on July 30, 2010 requiring the facility to comply with permit requirements. Since the issuance of the order, the facility has worked to come into compliance with some ordered provisions and is requesting additional time to implement the remaining ordered provisions due to financial considerations. Therefore, an Order is being issued with a revised compliance schedule consistent with deadlines in the NYSDEC Environmental Conservation Law CAFO permit that the facility is now covered under. The final compliance deadline is now June 30, 2014 with an interim deadline of December 31, 2012 for the final design of the bunk silo leachate collection system. Injunctive relief was previously calculated for facility under CWA-02-2010-3045.
