Case summary

Facility failed to submit the required US EPA Notification for Demolition and Renovation as required by 40 CFR part 61.145(b). On November 12, 2012, Respondent submitted its answer to the complaint. On February 11, 2013, EPA filed a Motion to Withdraw the Complaint since Respondent presented evidence in support of (1) its current financial capacity, (2) that the asbestos clean-up activities were conducted by the PR Land Authority (PRLA) prior to when Respondent took over the property, and (3) that the property returned to the previous owner, the PRLA. On February 14, 2013, the Chief Administrative Law Judge granted EPA’s Motion to Withdraw the Complaint.
