On December 6, 2011, the Respondent self-disclosed two possible violations at its electric generating facility, located at 790 Washington Road, Parlin, NJ 08859 to the U.S. Environmental Protection Agency (EPA), pursuant to EPA’s Incentives for Self-Policing: Discovery, Disclosure, Correction and Prevention of Violations (Audit Policy). Under the Emergency Planning and Community Right-to-Know Act (EPCRA) the facility disclosed that they had no documentation of the emergency planning notification information of the presence of sulfuric acid and anhydrous ammonia at the facility in reportable quantities and the the Tier II filing did not indicate the location of sulfuric acid in batteries in the facility’s auxiliary room. All issues have been corrected. Pursuant to the Audit Policy and based on information provided, we have determined that the facility meets the conditions of the Audit Policy for 100% elimination of the total gravity-based penalties which could have been otherwise assessed for the EPCRA violations outlined in the facility audit policy disclosure.
