Case summary

Region 9 submitted a referral alleging violations of CFC regulations at facilities in its region. Preliminary information from the company suggests a corporate-wide practice of violating CFC regulations. In order to facilitate settlement of CFC violations at all facilities in the US, through a multi-regional judicial action and settlement, Regions 2,3,6,7,8,9 and 10 are submitting referrals. The settlement resolves allegations that the Defendant violated the Clean Air Act by failing to promptly repair leaks of HCFC-22, a greenhouse gas and ozone-depleting substance used as a coolant in refrigerators, and failed to keep adequate records of the servicing of its refrigeration equipment. The Defendant will now implement a corporate refrigerant compliance management system to comply with stratospheric ozone regulations. In addition, the Defendant will pay a penalty.
