Respondent owns and operates the construction site, Frank Farm Subdivision – Phase II in Lagrange, New York which encompasses a total of 88.20 acres of land with 22.29 disturbed acres. Respondent received permit coverage on October 28, 2004 and construction activity at the site began in August 2007. Stormwater from the site discharges to a tributary to Wappingers Creek. Violations identified during 12/17/2009 and 5/5/2010 CEIs include failure to conduct regular site inspections, maintain stormwater BMPs, failure to develop a complete SPPP and a turbid discharge was observed on December 17, 2009 at the site in violation of the Permit. The final administrative penalty order includes a penalty for violations identified as a result of the 12/17/2009 and 5/5/2010 CEIs. Injunctive relief has already been included in the CCDS for Administrative Order CWA-02-2010-3022.
