Case summary
Respondents owned and operated the Subdivision Holubar construction site, on which greater than 1 acre was disturbed, and NYSDECs SPDES GCP permit coverage was never obtained. Following a June 16, 2008 inspection by EPA, an RFI was issued to Subdivision Holubar on February 2, 2009 (CWA-IR-09-010), under Section 308 of the CWA to assess compliance and was received by the permittee on February 3, 2009. The RFI was resent with an Overdue Notice issued March 31, 2009 and was received April 1, 2009. The respondents failed to provide the requested information and to date no response to the RFI has been received by EPA in violation of Section 308 of the Act.
