Case summary
In this Settlement Agreement and Administrative Order on Consent, Respondent agrees to install a system designed to block, intercept and capture contaminated groundwater seeping into the Raritan River, Cuckhold's Brook, and Middle Brook. Respondent also agrees to perform two groundwater studies to determine if there is movement of contaminated groundwater through the bedrock and overburden that may continue to seep into the water bodies. Finally, Respondent agrees to pay all EPA oversight costs for this action starting from the effective date of this Agreement. An Amendment, issued August 12, 2013, transfers oversight of certain specified actions being performed by the Respondent under the original Order from the Removal Branch of the Emergency and Remedial Response Division (ERRD) to the Remedial Branch of ERRD.
