Case summary

Facility was found in violation of Section 112(r) (1) of the Clean Air Act through a General Duty Clause evaluation done in September 15, 201. The Facility uses an Extremely Hazardous Substance (EHS) which is anhydrous ammonia in an industrial refrigeration system. After numerous safety code and industry standard violations were found, the U.S. EPA is ordering the Facility to comply with all applicable safety and prevention requirements that apply pertaining the SIC code 4222. Respondent will submit a report to the EPA that includes all findings, recommendations and plan of action within 60 and 45 days from the effective date of the order. Facility will submit an EHS inventory calculation and EPA will determine if Risk Management Plan Requirements apply.
