Case summary

Defendant is a national real estate developer and homebuilder performing construction activities that include vertical home construction on excavated and graded lots. Defendant did not have the applicable state permits (SPDES or NJPDES) for construction stormwater discharges at 65 construction sites in New York and New Jersey it owned and/or operated. There were violations observed by EPA inspectors at 23 sites, as well as violations at 42 additional sites that are documented in the Defendant's response to EPA's information requests. Region 2 seeks civil penalties for past violations, and injunctive relief requiring corporate-wide compliance at the Defendant's construction sites with the terms and conditions of the applicable permits. Consent Decree lodged on June 15, 2017, involving the Defendant's construction sites in several Regions, specifically, Regions 3, 4, and 5. Not a national case.
