EPA seeks the participation of the U.S. Department of Justice, in anticipation of negotiations with the PRPs to reach a settlement pursuant to which they will perform the remedial design and remedial action (RD/RA) for the third operable unit (OU3) and construct and cap required by the first operable unit (OU1) at the Swope Oil Superfund Site. Request DOJ participate in negotiations aimed at reaching a settlement with certain PRPs linked to the Site, pursuant to which they will fully finance and implement the remedial work described therein, will pay future response costs incurred by EPA in overseeing implementation of the remedy, and will reimburse EPA for past costs incurred with respect to OU1 and OU3.
