Case summary
On May 11, 2010, EPA performed a routine compliance evaluation inspection at the Kiryas Joel Poultry Processing Plant (KJPPP) and found the following violations of the Clean Water Act: (1) KJPPP's pretreatment facility overflows into storm drains and subsequently into waters of the United States in violation of 33 U.S.C.1311; (2) KJPPP has failed to obtain a Stormwater Discharge Permit and Storm Water Pollution Prevention Plan. KJPPP has discharged contaminants to storm drains in violation of 33 U.S.C. 1342(p); and (3) KJPPP has violated the pretreatment regulations promulgated pursuant to 33 U.S.C. 1371(b) by interfering with the local Publically Owned Treatment Plant (POTW) and failing to monitor industrial effluent. EPA requests an enforceable requirement that the plant bring itself into compliance with the provisions of the Clean Water Act as well as civil penalties.
