Case summary

Facility was inspected in May 2009 in response to a citizen complaint. The citizen observed dozens of open cans and containers of paint, adhesives, stains, and other unknown materials stored outside in close proximity to a pond and residential homes. Although the waste was ultimately disposed of properly, the inspection determined the Respondent was out of compliance with numerous RCRA requirements. 1) Failure to make a hazardous waste determination, 2) Failure to minimize releases of hazardous waste or hazardous waste constituents, and 3) Failure to obtain a permit (or complying with requirements necessary to be exempt from permitting). Payment of penalty and injunctive relief.
