Case summary
Violation of 40 C.F.R. Part 141, Subpart W, Long Term 2 Enhanced Surface Water Treatment Rule (LT2ESWTR) for failure to conduct and report the results of source water monitoring required under 40 C.F.R. §141.701, as well as violation of 40 C.F.R. Part 141, Subpart U, Stage 2 Disinfectants and Disinfection Byproducts Rule (Stage 2 DBPR), by failing to submit a standard monitoring plan, system specific study plan, or 40/30 certification as required by the Initial Distribution System Evaluation requirements of the Stage 2 DBPR. Injunctive relief includes the cost of E. Coli sampling, laboratory analysis as well as the time spent by the operator preparing the Stage 2 plan.
