EPA v. Eagle Recycling of NJ (SB)

Unilateral Administrative Order Without Adjudication

Case summary

Based on EPA inspections findings of inadequate supervision and oversight and sampling results which confirmed the presence of asbestos at the facility and at other locations which have received shipments from the facility, the facility's location adjacent to a residential community, the lack of adequate worker protection, and other factors, EPA determined that the Eagle Recycling Facility may present an imminent and substantial endangerment to human heath and the environment. EPA orders the Facility to cease offsite shipment of waste except as specified in the Order, clean their process building, upgrade air cleaning equipment, institute waste screening and worker protection programs, and meet local wastewater pretreatment requirements.
