Case summary
This is an Administrative Settlement Agreement under Section 122(h) of CERCLA that provides for the 100% recovery of previously unreimbursed costs associated with the New York Environmental Recovery Group Site in Fort Edward, New York. The Respondent to the Order contracted with the Site operator, New York Environmental Recovery Services, Inc. (NYERS) for the treatment and/or disposal of regulated asbestos-containing material (RACM) removed from the Respondent's Corinth, New York, facility. The RACM came to be located at NYERS place of operations at One Liberty Street in Fort Edward, New York. The Respondent previously performed asbestos removal at the Site under a removal order and paid EPAs associated oversight costs.
