Case summary
Seeking immediate assistance in aid of access to a Superfund Site in Clifton NJ. After the operator (Abrachem Group LLC) at the Site heavily conditioned EPA's access, EPA issued a unilateral order to Abrachem on DATE. After a conference with Abrachem, EPA notified Abrachem that it would not modify the access order. Abrachem wrote to EPA that it would still only provide access on its terms. EPA deemed this a refusal to comply with the access order. Granted an ex parte administrative warrant for access in January 2009.
