EPA v. Joseph A. Weber Funeral Home, Inc.
Unilateral Administrative Order Without Adjudication
Case summary
The facility has an on-site large capacity cesspool which received embalming fluids until June 30, 2006, when the facility implemented the hold-and-haul medical waste box/waterless aspirator. At the time of the inspection, the facility had not sampled the cesspool to determine whether residual contamination is present. The EPA requests that the facility provide a closure plan to sample and remediate, as necessary. The facility is required to install a septic system for the injection of sanitary waste, only, or apply for a permit to operate the large capacity cesspool. Permit application is not recommended because of rigorous monitoring requirements, which may be cost prohibitive.
