Case summary

On September 8, 2008, Region 2 issued an Administrative Order on Consent (AOC) to the Respondent relating to the Hudson River PCBs Superfund Site, which is located in the State of New York. The AOC provides for soil sampling at approximately 1,000 locations within the Upper Hudson floodplain as the initial phase of a Remedial Investigation. Previously, EPA conducted a floodplain evaluation as required by the February 1, 2002 Record of Decision in which EPA selected a dredging remedy for the Site. That evaluation identified high levels of PCBs in floodplain soils, resulting in EPA’s oversight of a removal action performed by the Respondent. The AOC also provides for preliminary ecological and human use area mapping to identify areas where further removal actions may be needed, and for reimbursement of EPA’s oversight costs. On July 23, 2009, a modification to the administrative settlement agreement and Order on Consent was signed, incorporating an additional amount in sampling costs.
