Case summary

Administrative order on consent under Sections 104, 107, 122(a), and 122(d)(3) of CERCLA, for performance of a Remedial Investigation and Feasibility Study (RI/FS) for the Berry’s Creek Study Area portion of the Ventron/Velsicol Superfund Site located in the Boroughs of Carlstadt, East Rutherford, Moonachie, Rutherford, Teterboro, and Wood Ridge, in Bergen County, New Jersey. The Site encompasses approximately 12 square miles of wetlands inside the Hackensack River watershed. Respondents (approximately 100 in number) fit into three categories: (1) those that are PRPs at the SCP Superfund Site, which drains into Berry’s Creek; (2) those that processed wastes containing mercury, or sent wastes containing mercury for processing, at the Ventron/Velsicol portion of the Site; and (3) other companies whose wastes drained into, or otherwise impacted Berry’s Creek. Each Respondent generated, and disposed of, at least one of the hazardous substances on EPA’s list of contaminants of concern for the Berry’s Creek Study Area. Under this Order, Respondents will perform an RI/FS for the Berry’s Creek Study Area, out of which a final remedial action for the Berry’s Creek Study Area will be chosen.
