Case summary
The Defendants failed, as owners and/or operators, to comply with Part VII of the Puerto Rico Air Regulations, and the National Emission Standards for Municipal Solid Waste Landfills, 40 C.F.R. Part 63, Subpart AAA (the Landfill MACT), by failing, on or before November 5, 2005, to construct a gas collection and control system (GCCS) for the Landfill, failing to timely report Arecibo Landfill's design capacity and NMOC emissions report, to submit a final GCCS design plan; also failing to conduct testing for methane concentration. Supplemental referral signed on June 30, 2009, seeking injunctive relief under Section 7003 of RCRA, to address the potential imminent endangerment to human health or the environment due to the actual conditions at the Arecibo Municipal Solid Waste Landfill.
