Case summary
As a result of an EPA inspection, the Defendant, owner/operator of a petroleum refinery, which produces asphalt, was found to be in violation of the leak detection and repair requirements of 40 C.F.R. 63.640-63.679 and 40 C.F.R. 63.160 - 63.183, as well as associated title V Operating Permit conditions. Relief obtained includes a civil monetary penalty to be shared equally with New Jersey. The plant is currently closed and appears to be no plans to restart. However, if it does reopen, the CD provides for injunctive relief of enhanced LDAR.
