EPA v. W.R. Grace (NC)(NLP)
Final Order With Specified Cost Recovery
Case summary
The Li Tungsten Site is one of approximately 29 CERCLA sites at which EPA has a claim for cost recovery. A proof of claim was filed in March of 2003, and the bankruptcy court allowed the claim, against W.R. Grace, in that amount. It is not certain when the distribution of the assets will occur and how much of the claim will be realized upon disbursement. On June 2, 2008, the United States Bankruptcy Court for the District of Delaware approved a multi-site bankruptcy settlement with WR Grace.
