Case summary
The CD resolves violations at the Defendant's Howard M. Down electric generating facility. �When fully implemented, actions required by the CD will reduce emissions of nitrogen oxide, carbon monoxide, and particulate matter.� The CD requires the Defendant to pay a civil penalty, and, in order to comply with the CD, install a new 60 megawatt (nominal) dual-fuel natural gas and number 2 fuel oil turbine and install a pollution control device on an existing unit. �The CD also requires the Defendant to be in compliance with the applicable state implementation plan (SIP) -approved opacity, CO, and NOx reasonably available control technology (RACT) emission limits for all four of the units, as set forth in the Facility�s title V operating permit, no later than the effective date of the CD. Additionally, the CD requires the Defendant to cease burning coal at Unit 10 no later than December 31, 2010.
