FINDINGS OF VIOLATION 1) EPA conducted an inspection of Respondent's facility, located at 4627 Smith Road, Marion NY on October 18, 2006. 2) The inspection revealed that lone trench floor drain contained a semi-clear fluid and nearby shop floor appeared stained. The drain leads to a pipe buried in stone. Stored near the drain are containers with anti-freeze, waste oil and a solvent parts cleaner. 3) Based on the information revealed during the inspection referred to in paragraphs 12-13, above, Respondent is in violation of 40 C.F.R. 144.11 and 40 C.F.R. 144.12.
