EPA v. Davis Funeral Home, Inc.

Case summary

The EPA inspection on July 18, 2006 and subsequent owner responses to the November 13, 2006 EPA Request for Information revealed that: a) there is a primary cesspool with a secondary cesspool which receives on-site sanitary bathroom waste; and wastewater from the preparation room sink (embalming room). Prior to March 3, 2006 the cesspools received human body fluids and embalming fluids which now go to a medical waste blood box. The primary with secondary cesspool is 1) a large capacity cesspool; and prior to March 3, 2006, 2) used as an industrial process water and waste disposal well. There is no evidence that the cesspools have been pumped clean or sampled and analyzed since conversion to the use of the medical waste blood box. Existing large-capacity cesspools were to be closed by April 5, 2005 and new or converted construction of large-capacity cesspools was prohibited as of April 5, 2000. b) There are also two interconnected interior floor drains in the basement preparation room which discharge to a single pool located underneath the floor.
