Case summary
1) Service Corporation International (Respondent) is a Person within the meaning of Section 1401(12) of the SDWA, 42 U.S.C. 300f(12). 2) Respondent owns and/or operates the Casimir Funeral Home facility located at 523 Route 112, Port Jefferson Station, NY. 3) There is a Class V injection well at the facility, as defined at 40 C.F.R. 144.6(e) and 144.80(e). 4) The facility discharges wastewaters into or above the Long Island Sole Source Aquifer, a USDW. 5) Embalming wastes were injected into a cesspool until early 2006. However, facility has now implemented a medical waste containment system for embalming waste fluids. 6) High Capacity cesspools were required to close by April 5, 2005. 7) Based on the above, Respondent is subject to the requirements of the UIC program established pursuant to the SDWA. 8) EPA issued a Notice of Violation and proposed Administrative Order for Compliance on February 16, 2007.
