III. JURISDICTIONAL STATEMENTS 1) Giove Funeral Home, Inc. (Respondent) is a Person within the meaning of Section 1401(12) of the SDWA, 42 U.S.C. 300f(12). 2) Respondent owns and/or operates a facility located at 640 Middle Country Road, Middle Island, NY11784. 3) There is a Class V injection well at the facility, as defined at 40 C.F.R. 144.6(e) and 144.80(e). 4) The facilitys injection well(s) discharge into or above an aquifer that meets the definition of an Underground Source of Drinking Water (USDW). The facility discharges wastewaters into or above the Long Island Sole Source Aquifer, a USDW. 5) Wastewater from funeral home prep rooms typically contain wastes such as phenol and formaldehyde as well as bodily fluids that can pose a threat to human health if ingested in drinking water 6) Based on the above, Respondent is subject to the requirement of th UIC program established pursuant to the SDWA. 7) EPA issued a Notice of Violation and proposed Administrative Order for Compliance on February 1, 2007. 8) The public notice of the Proposed Order was published on the EPA Region 2 website for thirty days, from February 9, 2007 until March 11, 2007.
