Case summary

EPA had responded to several mercury incidents at the CMS Dr. Javier J. Anton Center for Diagnostic & Treatment, under CERCLA, including a fire incident and several spills in which it was discovered that metallic mercury had spilled throughout the Facility. The facility failed to characterized and properly managed and disposed of hazardous mercury waste. Therefore, under the authority of Section 3008(a)(3) of RCRA, 42 U.S.C. 6928(a)(3), and the RCRA Civil Penalty Policy, and based on the seriousness of the violations to comply with applicable RCRA requirements, EPA proposes the assessment of a civil penalty in the total amount of $85,150.
