Case summary

Respondents operated a hazardous waste management facility and stored hazardous waste without having obtained a permit or qualifying for interim status, and did so for an extended period of time (over 3 years). Respondent failed to prepare and/or maintain required facility hazardous waste manifest and land disposal records and were unable to account for some 10,000 pounds of hazardous waste. In addition, Respondents: Released mercury vapor to the atmosphere through the disposal of spent fluorescent light bulbs as trash in the regular garbage; Storaged perc solvent in drums and tanks, adjacent to channels and floor drains leading to a storm drain in the alley, risking release in the event of a spill or leak (facility did not have available spill control and decontamination equipment); and Storaged hazardous waste perc in open containers. Also, open perc sludge and muck transfer containers and brushes were caked with perc-contaminated, hazardous waste residue. This Case Action brings a halt to the aforementioned activities and substantially reduces, if not eliminates, regular generation of hazardous wastes thru injunctive relief and employs a pollution prevention SEP to further reduce environmental pollutants.
