Case summary
McIntosh Laboratory, Inc. failed to submit a Toxic Release Inventory Form R report for lead for calendar years 2001, 2002 and 2003. This failure to submit Form R reports, in a timely manner, constitute violations of Section 313 of the Emergency Planning and Community Right-to-Know-Act, 42 U.S.C. § 11023, and with 40 C.F.R. § 372.30. EPA and McIntosh Laboratory, Inc. agree that settling this matter by entering into this Consent Agreement and Final Order pursuant to 40 C.F.R. §22.13(b) and 40 C.F.R. §22.18(b)(2) and (3), is an appropriate means of resolving this case without further litigation. To that end, McIntosh Laboratory, Inc. agreed to pay a penalty of $24,360. The required Toxic Release Inventory Form R reports have been submitted.
