Case summary

The company failed to file a correct and timely Toxic Release Inventory Form R report for lead for 2004. Subsequent to receiving the complaint, the company did an in-depth review of the disposition of lead at the facility from 2003 to the present. The company determined that lead usage was 33 pounds during 2004 rather than the>2,500 pounds processed in prior years. This difference was due to transferring all production line operations utilizing lead to their Juarez, Mexico facility which left only a small “wave solder” prototyping line operation at the Syosset plant for assembling printed circuit board panels. A small amount of hand soldering was still being performed in several engineering labs. The approximately 80 pounds of molten lead in the bath and stored accumulated dross would not count towards the 2004 reporting threshold until it was processed as part of their final product or transferred off-site. The company thus did not meet the 100 pound reporting threshold for lead for 2004. Honeywell will be withdrawing the 2004 lead submission from the TRI database which was the basis for the administrative complaint.
