Case summary

U.S. Pipe & Foundry Company (EPA TRI Facility ID: 08016SPPFNEASTP) failed to submit a Toxic Release Inventory Form R reports for zinc compounds for each of the calendar years 2001, 2002 and 2003. The Respondent submitted the Forms R to the EPA on December 5, 2006. This failure to submit Form R reports, in a timely manner, constitute violations of Section 313 of the Emergency Planning and Community Right-to-Know-Act, 42 U.S.C. Section 11023, and with 40 C.F.R. Section 372.30. Supplemental Environmental Projects (SEP). : The facility has agreed to a pollution reduction SEP to install and operate a treatment unit which will filter the water discharged from the existing stormwater basin, via a pump, through a series of filters to remove total suspended solids and other environmental pollutants (including PCBs and zinc compounds) prior to discharge into the Delaware River. This is a combined administrative civil complaint and consent agreement final order action with a cash penalty of $13,125.
