Unilateral Administrative Order Without Adjudication
Case summary
Permitte failed to have proper procedure and authority in place for acceptance of hauled waste in violation of the pretreatment program. EPA issued an order on March 22, 2005 requiring pemrittee to meet program requirements by January 2006. Permittee did not fully comply with reqirements in the March 2005 Order. EPA and permittee negotiated a compliance plan which is reflected in the action. Complying actions to be performed by the permittee include sampling and testing of hauled waste from industrial origins.
